Terms of Service

Effective April 19, 2026

1. Acceptance

By accessing thenode.pro, subscribing to The Node, or receiving emails from us, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction.

3. Subscriptions and billing

• Paid subscriptions are billed monthly through Shopify Subscriptions (managed by Appstle). Pricing is shown at checkout in USD.
• Subscriptions auto-renew until you cancel. Cancel any time from your Shopify customer portal — access continues until the end of the paid period.
• All sales are final. We do not provide pro-rata refunds, but contact billing@thenode.pro if you believe there's a billing error.

4. NOT FINANCIAL ADVICE

The Node is an information service. Nothing we publish — including the daily market brief, the live stream, the chat, or any analysis generated by Vertex AI / Gemini — is investment, financial, legal, accounting, or tax advice. AI-generated content can be inaccurate or outdated; verify everything independently. Trading crypto and securities involves substantial risk of loss. You are solely responsible for your investment decisions. Consult a licensed advisor before acting on anything you read here.

5. Acceptable use

You agree not to:

• Resell, scrape, or republish the newsletter or any platform content.
• Reverse engineer the API, attempt to bypass authentication, or share your account credentials.
• Use the service to spam, harass, or transmit unlawful content.
• Generate content via the AI tooling that violates Google's Generative AI Prohibited Use Policy.

We may suspend or terminate accounts that violate these rules without refund.

6. Intellectual property

The Node owns the brand, the website code, the email templates, and the editorial curation. You retain ownership of your watchlist data. You grant us a limited licence to process that data to deliver the service. Third-party logos and quoted news headlines remain the property of their owners.

7. AI-generated content disclaimer

The daily brief is composed by Google Gemini (Vertex AI) using live web search. We don't guarantee accuracy, completeness, or that prices are current at the moment you read the email. Sources are cited so you can verify; please do.

8. Service availability

We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Shopify, Google Cloud, Vertex AI, Gmail), and force majeure events may cause temporary unavailability.

9. Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, The Node, its operators, and contributors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for trading losses, lost profits, or lost data, arising out of your use of the service. Our aggregate liability shall not exceed the amount you paid us in the three months preceding the claim.

11. Indemnification

You will indemnify and hold The Node harmless from claims arising out of your breach of these terms or your trading decisions.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes shall be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.

13. Changes

We may update these terms. Material changes will be announced on thenode.pro and via email. Continued use means acceptance.
